1 - Use of the website

The Website www.manasiki.com is available to its users, subject to unconditional acceptance by each user (hereinafter referred to as l’« User ») of the Terms and Conditions of this contract.

Manasiki Travel makes available to its users :

• The content of its website, whether it be texts, files or advice.
• Search services that allow the user to find the offers and hotels about which he wishes to have information.
• The online store where the user can buy items necessary for the trip of the Hajj or the Omra.
• The Omra, hajj, cultural or hotel type travel booking service where the user can define his travel choices and book online by paying only the booking fees.
• The online pre-booking service.

The User acknowledges that he is of legal age (at least 18 years of age) and has the legal capacity to understand and apply the terms of this Agreement and to use this website, in accordance with the General Conditions set out below.

In addition, to access and use this website, the User undertakes to provide authentic, complete information and undertakes to keep it updated.

The User undertakes to keep confidential the access codes to the website assigned to him by Manasiki Travel. It will ensure that unauthorized third parties do not have access to it. The User undertakes to assume the economic consequences deriving from the use of this website as well as from the use of its access codes by third parties.

This website is unique and exclusively for the personal use of the User. Any modification, reproduction, duplication, copying, distribution, sale, resale and other form of exploitation, with or without commercial purposes is strictly prohibited.

The User undertakes not to use this website for any illegal or prohibited purpose. The User agrees to use this site only for himself and accepts that the products or services acquired through the website are for personal use or consumption or for that of the persons on whose behalf he is authorized to act.

2 - Reservation of tourist packages or stay at the’hotel

The site www.manasiki.com allows the User to access information relating to the products and services of third parties whose activity is related to Hajj or Omra and to make reservations for these products.

The reservation by the User of products or services or travel, is subject to the specific terms and conditions established by GO-MAKKAH. The User agrees to accept and comply with the terms and conditions of purchase defined by the supplier whose services he chooses. It undertakes, without restriction, to pay the expenses incurred and to comply with the standards and restrictions relating to the availability of the rates, products or services offered. If special standards or restrictions affect the rates, products or services offered and chosen by the User, such special standards or restrictions will be communicated to him explicitly on the site before he makes his reservation.

The development and updating of information relating to offers, products, services, prices, routes, distances, characteristics as well as other data and information relating to the products and services offered on the website are the sole competence of Manasiki Travel Morocco.

In accordance with article L.134-2 of the Consumer Code, the electronic document formalizing the contract for the reservation of products and/or services will be archived in the Manasiki Travel registers and will be accessible by the User at any time if he makes the prior request.

The’user must read the information and recommendations of the Saudi and local authorities concerning the pilgrimage to Mecca, in particular by consulting the websites of the Ministry of Hajj (http://hajjinformation.com).

It is the responsibility of the’User to respect the formalities of’registration for the Hajj or Omra visa application, or other visa required to enter the visited territories. The’User will be solely responsible for the losses and damages incurred as a result of’User's failure to comply with formalities of this nature.

Please note that many countries, apart from’ Saudi Arabia, also require that the passport presented is valid at least six months after the period of your stay. Regulations vary from one country to another, the’User is invited to contact the’embassy or consulate of its destination to obtain relevant, accurate and updated information.

Minors and young children must be in possession of their own passport. The name on the passport must be the same as the name on the booking request.

3 - Conditions of withdrawal, cancellation and modification

According to’ article L.121-20-4 of the Consumer Code, the right of withdrawal is not applicable to contracts for the provision of accommodation, transport, catering or leisure services that must be provided on a date or at a specified periodicity. Our tourism packages belonging to these different categories, the’User does not benefit from any withdrawal period in the context of orders placed on the site.

For the period of HAJJ and RAMADAN

For the period of Hajj or Ramadan, no refund is possible for all reservations, regardless of the date of cancellation.

Trip cancellation by Manasiki Travel

Any cancellation of the trip or stay by Manasiki Travel must be made by registered letter. It leads de facto to the reimbursement of’a part or all of the sums already paid following the incidents.

Manasiki Travel is exempt from any liability in the case of « force majeure ». That is to say when’il is forced to proceed with the cancellation by the fact of an external event, unpredictable and insurmountable.

If the contracted trip also provides for a minimum threshold of participants and it is not reached, Manasiki Travel can proceed to its cancellation outright. But he is then required to notify you within a minimum legal period of 21 days before departure or the date set by the contract and to proceed with the refund. No penalty is payable in this case on your part.

Cancellation by the customer

Apart from a serious impediment, the traveler can not proceed to a cancellation without it causing the complete loss of the sums already paid.

This cancellation is considered as a pure and simple breach of contract. As such, the traveler is therefore forced to repair in addition the damage suffered by Manasiki Travel since the’agence has committed itself to various subcontractors (carriers, hotels, etc.).

Cost of changes or cancellation

The entire service modified or cancelled due to the customer can be invoiced, in particular for changes on the part of the customer intervening at 30 days and less of departure, in accordance with the conditions of the technical organizer.

Fees applied:

• More than 60 days before departure and before the issue of’avion tickets : 10 % of the total price ;
• Between 60 days and 31 days before departure and before the issue of’avion tickets: 30% of the total price ;
• Between 30 days and 21 days before departure and before the issue of’avion tickets: 50% of the total price ;
• Less than 21 days before departure or after issue of’avion tickets : 100 % of total price ;
• For all bookings of’une Omra during the month of Ramadan or Hajj and regardless of the date of’ cancellation before departure : 100 % of the total price.

Note : Any request for’ cancellation or modification must be addressed to Manasiki Travel, and made by any means allowing an acknowledgment of receipt ; will be considered as effective date the working date on which your mail will be received at the’agence when you register.

Transfer of a trip to a third party

Under articles L.211-12 and R.211-9 of the tourism code, it is possible for you to assign your travel contract to a third party on the condition that it meets the same conditions as you.

However, you must notify Manasiki Travel by registered letter acknowledged receipt within a period not exceeding 7 days before the departure date.

Attention : This assignment does not remove your liability to Manasiki Travel. You remain jointly and severally liable for the balance of the remaining price to be paid as well as for any additional costs incurred by this transfer.

Changes to essential elements of the contract

Changes to essential elements of the contract are any change in the dates of stay, itinerary, destination (region) or a significant increase in rates. These changes do not constitute sufficient grounds for terminating the contract and obtaining its immediate refund, as it may happen that one or more such changes occur the day before or during travel.

Cancellation insurance

Finally, remember, if you are the originator of the cancellation, to check if you do not have cancellation insurance, especially if you paid for the trip with a Gold or Visa Premier card.

4 - Online shop

The products offered are those that appear in the online store of Manasiki Travel. These products are offered within the limits of available stocks.

The photographs of the online store are as faithful as possible but cannot ensure a perfect similarity with the product offered, especially with regard to colors.

Tariffs

The prices listed in the online shop are inclusive of VAT prices taking into account the VAT applicable on the day of the order ; any change in the rate may be reflected in the price of the products or services.

Manasiki Travel reserves the right to modify its prices at any time, however, it being understood that the price appearing on the site on the day of the order will be the only one applicable to the buyer.

The prices indicated do not include the costs of order processing, transport and delivery.

All costs and expenses associated with the procedure of customs clearance, customs brokerage, damage and storage costs, transportation abroad and within’ and any other costs or charges will be paid in full by the’User in the country of destination.

Commands

The buyer, who wishes to purchase a product must:

• Fill in the identification form on which it will indicate all the requested contact details ;
• Fill out the order form online ;
• Validate your order after checking it ;
• Make the payment under the conditions provided for ;
• Confirm your order and payment.

Confirmation of the order implies acceptance of these conditions of sale, recognition of full knowledge and waiver of its own conditions of purchase or other conditions.

All data provided and the recorded confirmation will be proof of the transaction.

The confirmation will be worth signature and acceptance of the operations carried out.

The seller will communicate by e-mail confirmation of the registered order.

Delivery service

Deliveries are made to the address indicated in the order form.

The risks are the responsibility of the purchaser from the moment the products have left the premises of Manasiki Travel. In case of damage during transport, the reasoned protest must be made to the carrier within three days of delivery.

Delivery times are given as an indication only; if they exceed thirty days from the order, the contract of sale may be terminated and the buyer refunded.

Discount for large orders

A purchase discount of 5% is granted by the seller for orders including more than 10 items of the same product to natural or legal persons.

Payment Terms

Payments are made by credit card ; they are made through the secure system that uses the SSL (Secure Socket Layer) protocol so that the transmitted information is encrypted by software and no third party can become aware of it during transport over the network.

The buyer's bank account will be debited with the amount of the invoice and participation in transport costs.

At the request of the buyer, he will be sent a paper invoice showing VAT.

5 - Privacy policy and protection of personal data

Manasiki Travel respects the right to privacy of the User and protects personal data. To access the services offered by Manasiki Travel on our website, the User must provide us with personal data when booking online (hereinafter referred to as, « Booking Form »).

In accordance with the Law of 6 January 1978 relating to’informatics, files and freedoms (hereinafter referred to as « Computer Law and Freedoms »), Manasiki Travel wishes to inform you that by filling out a Booking Form, your personal data will be added and processed in the files of Manasiki Travel. They will allow us to:

• Make offers and services to you (booking management and payment of reserved products and services).
• Send you information and promotional offers from Manasiki Travel of the suppliers of products or services.
• Use them for statistical and market trend analysis purposes.

To be able to customize our services, adapt them to your interests and needs and allow us to communicate to you the best offers on the market, we ask you to periodically update your data and inform us of any changes.

Manasiki Travel informs the User of the possibility and his right of access, rectification, deletion and opposition to the personal data concerning him contained in the data file managed by the company Manasiki Travel. If you wish, you can also exercise the aforementioned rights by sending an e-mail to support@manasiki.com.

Data transmission

In the event that the User wishes to book the products and services displayed on the Manasiki Travel website, Manasiki Travel undertakes to communicate his personal data to the suppliers of the products and services and/or to the tour operators concerned; said suppliers undertake to use the User's personal data for the sole purpose of fulfilling their contractual obligations.

The suppliers of the products and services, or the suppliers of products/services, to whom the personal data are communicated, are subject to compliance with the Data Protection Act, in accordance with article 3 of the same Act.

In accordance with the provisions of article 69 of the Data Protection Act, the User agrees that his data will be transmitted to the recipients as referred to in the previous point, in accordance with the terms and conditions stated, without geographical restriction, including in countries that are not able to offer a level of protection comparable to that offered by the Data Protection Act.

In any case, Manasiki Travel guarantees the confidential treatment of the User's personal data and that the server in which its data is kept and processed respects all the necessary security measures to avoid access to unauthorized third parties.

Any unlawful use of the content of the Website is strictly prohibited, including the reproduction, modification, distribution, transmission, publication or partial or total representation of its content.

Any use of the images contained on the Manasiki Travel website, outside the website and without the express consent of Manasiki Travel or its suppliers, is strictly prohibited.

Manasiki Travel disclaims all liability to’User in connection with bookings of travel packages, for which Manasiki Travel acts solely as a booking intermediary, within the limits permitted by the applicable law.

Manasiki Travel assumes no responsibility for the accuracy, completeness, updating and accuracy of offers relating to products and services offered on the website by third party providers, for which Manasiki Travel acts solely as a booking intermediary. Manasiki Travel systematically communicates to the’User the name and contractual conditions of’ possible third-party providers, before the conclusion of the contract. By booking, the’User acknowledges having read and accept them in full.

Manasiki Travel reserves the right to modify its website and these Terms and Conditions of Use without notice. In such a case, the modifications will enter into force as soon as they are put on line, but will only be applicable to bookings made after they are put on line.
